DISCUSSION: The passage tells you about the different ways that Native Americans can protect their graves.
___________
- The passage only described methods that currently exist. The author never said if more protection is a good idea.
- The passage does answer this question. It’s easier to protect a recent burial ground (lines 13-17).
But the correct answer needs to cover the entire passage. This answer ignores paragraphs 2 and 3.
- CORRECT. This covers all paragraphs. Natives can protect their graves if they prove standing (paragraph 1).
Buried property is not abandoned (paragraph 2), and museums can’t buy collective property from an individual (paragraph 3).
- We’re not told why the courts care. Presumably they’re just applying the law, but the passage doesn’t discuss their motives.
- This isn’t addressed. There’s a different between protecting a grave and claiming ownership of the land around the grave.
