LSAT 101 | Section 4 | Reading Comprehension: Q14

LSAT Preptest 101 explanations

RC Question 14 Explanation

DISCUSSION: The first paragraph shows that it can be difficult to acquire standing in cases involving ancient grave sites, but that the law can be useful to Native groups who do acquire standing.

The second and third paragraphs support this claim with specific examples.

___________

  1. This isn’t true. The third paragraph shows that Native Americans could reclaim communal objects that were sold by an individual.
  2. This ignores the first and second paragraph.
  3. This describes part of the first paragraph, but ignores paragraphs two and three.
  4. CORRECT. Standing is covered in the first paragraph. Paragraphs two and three provide examples of how the common law can protect Native claims.
  5. This isn’t even true. There could be other ways for Natives to make progress. They might get Congress to pass a law that prevents museums from taking artifacts from grave sites.
It’s also possible that Natives can show standing in enough disputes that the law as it stands could allow Natives to make significant progress.
