DISCUSSION: The two theories have very little in common. CLS describes law as a tool of the elite. Law and Literature believes law to be art.

Both theories draw on disciplines from outside law. That’s their only common point. See lines 27-29 and 35-37. (Interdisciplinary refers to some disciplines from outside the law.)

  1. Law and Literature never mentioned elites.
  2. We’re never told how natural law and legal positivism relate to non-traditional theories.
  3. Law and Literature never says much about power. Its main point is that we should view judicial opinions as art.
  4. CORRECT. See lines 27-29 for CLS, and lines 35-37 for Law and Literature.
  5. Only Law and Literature advocates believe this (line 51).
