LSAT Preptest 21 explanations

RC Question 9 Explanation

DISCUSSION: The passage is a neutral description of several legal theories. In particular, the passage focuses on legal theories that have been developed since the 1970s (line 12).

___________

  1. CORRECT. The passage mainly focusses on the three recent theories that try to explain what the law is: law and economics, critical legal theory, and law and literature.
  2. The passage is not talking about how to interpret the law. It’s talking about how to define what law is.
  3. The passage never says which theory is best. Also, there may be other, more coherent theories apart from the three modern theories mentioned.
  4. The passage never says that Law and Literature has anything to do with the other theories. It seems pretty far removed from them.
  5. The passage only mentions the traditional theories in the first paragraph. We have no evidence that they are on the defensive: their advocates might still feel dominant.
