DISCUSSION: The first paragraph is the key to understanding this passage. There have been many Native land claims, and they show a clash of values between Native tribes and the U.S. court system.

The Mashpee are offered as an extended example of this phenomenon.

  1. The author never says how we can solve the problem of conflicting values.
  2. CORRECT. The general problem is the clash of values when Native Americans try to win cases in court. The Mashpee are an extended example of how it is difficult for tribes to present oral history as evidence.
  3. This would mean that the author looked at the Natives’ and the Courts’ approaches and formed a unified solution based on the two methods. That didn’t happen.
  4. There was no earlier solution. The Mashpee lost their land.
  5. The author didn’t reinterpret the court’s analysis. They just criticized the court for failing to consider valid oral history (lines 49-51).
