LSAT Preptest 154 explanations

RC Question 27 Explanation

DISCUSSION: “Dearth” is just a fancy way of saying “not much”. The start of the highlighted sentence in Question 26 tells us that they were lacking in systematic empirical studies into how much nations conform to CIL principles.

___________

  1. CORRECT. The author says that we currently don’t know how much nations conform to the principles of customary international environmental law.
  2. This comparison has never been brought up in the passage.
  3. We only know of two practices currently being used (CIL and treaties and negotiations), and that the latter is more successful. We don’t know about any other legal remedies.
  4. It’s currently a violation of CIL norms. We don’t know if it would violated negotiated international treaties.
  5. The passage tells us that the scholars already “generally accept an established criterion”, which are the things they agree on.
