2. CORRECT. This is the best answer. The word “ultimately” captures the sense that there is something to the idea, but when you fully consider all cases it doesn’t work. (i.e. the third paragraph, which sums up the author’s verdict.)
3. This isn’t the main point. This is just a statement that is part of tangible copyright theory (which the author thinks is an inadequate theory.) See lines 24-28.
4. The author doesn’t say this! The third paragraph implies they think copyright should exist. For instance, they suggest that live sports broadcasters have a right to control how their work is used.
