DISCUSSION: Paragraph one gives us context for paragraphs two and three. Paragraph two criticizes outcomes analysis while paragraph three shows us better solutions.

  1. This only describes traditional legal research. Outcomes analysis analyzes all cases, not a limited number.
  2. The techniques in the third paragraph analyze more factors than outcomes analysis does. But the author thinks these techniques are more successful.
  3. We only have one example of a flawed technique: Zirkel and Schoenfeld’s use of outcomes analysis. Other scholars may all use good techniques.
  4. CORRECT. This covers paragraphs two and three. Paragraph two criticizes outcomes analysis, and paragraph three shows us two better techniques.
  5. The two techniques in paragraph three are promising, but “considerable certainty” may be too high a standard.
     
    Also, this ignores outcomes analysis.
